1. General provisions and information about the website operator

These Terms of Use govern access to and use of the website www.pepeks.hr (hereinafter: the Website).

The Website is operated by PEPEKS drustvo s ogranicenom odgovornoscu za prijevoz, trgovinu i usluge, with registered office at Trnjanski nasip IV. 20, 10000 Zagreb, VAT ID (OIB): 09182507965, registered with the Commercial Court in Zagreb (hereinafter: PEPEKS).

PEPEKS can be contacted via the email address info@pepeks.hr and other contact details published on the Website.

These Terms apply to every visitor of the Website from the moment of accessing the Website. They govern the use of the Website but do not replace the General Terms of Transport or any specific terms applicable to a particular ticket, tariff, offer or contract.

2. Purpose and content of the Website

The Website provides information about PEPEKS, scheduled and charter passenger transport, timetables, routes, stops, prices, contacts, passenger rights and other related services.

PEPEKS makes reasonable efforts to keep the information published on the Website accurate, complete and up to date. However, certain operational data, in particular timetables, departure and arrival points, stops, prices, seat availability and other data related to a specific trip, may subsequently change.

Users are advised to check the information relevant to their departure shortly before travelling. For a specific trip, the information stated on the issued ticket, the applicable timetable, the terms of the selected tariff, the General Terms of Transport and mandatory regulations shall prevail.

The foregoing does not limit the rights of users or passengers that may arise from inaccurate, incomplete or misleading information for which PEPEKS is liable under applicable regulations.

Unless expressly stated otherwise, information published on the Website is provided for informational purposes and does not in itself constitute a binding offer to conclude a contract.

3. Charter transport inquiries

Users may request information or an offer for charter transport via the contact details or the form on the Website.

Submitting an inquiry through the Website does not constitute a transport booking, acceptance of an offer or conclusion of a contract. A charter transport contract is concluded only once PEPEKS provides the user with an offer or confirmation containing the essential transport terms, and the user accepts it in the manner stated in the offer or confirmation.

Charter transport is subject to the terms stated in the individual offer or contract, as well as other terms and regulations referenced by the offer or contract.

4. Purchasing tickets via Traveling.com

PEPEKS does not process direct online ticket sales on the Website.

By selecting the button or link to purchase a ticket, the user is redirected to the Traveling.com online platform, operated by Get By ApS, Klamsagervej 32, 8230 Abyhoj, Denmark. Before redirection, the user must be clearly informed that they are leaving the PEPEKS Website.

The search for departures, the technical purchase process, the user account, payment method, order processing, issuance and technical delivery of the e-ticket, platform fees and the operation of the platform are governed by the terms of use and privacy policy of Traveling.com.

If PEPEKS is listed as the carrier on the ticket, PEPEKS is liable for performing the transport to the extent prescribed by its General Terms of Transport and mandatory regulations. This particularly covers boarding, the transport of passengers and luggage, the conduct of driving staff, and passenger rights related to delay, cancellation or other irregularities in transport performed by PEPEKS.

For questions related to payment, technical receipt of the e-ticket, the user account or the functioning of the platform, users should contact Traveling.com support using the contact details stated on the platform or the purchase confirmation.

A request for a voluntary change, cancellation or refund of an online-purchased ticket is submitted via the channel stated on the ticket, purchase confirmation or platform. The right to a change or refund depends on the applicable tariff, carrier, sales channel and mandatory regulations.

This division of roles does not exclude any liability that PEPEKS or Get By ApS may have towards the user under mandatory regulations or their actual contractual role in a given transaction.

5. Contact form and electronic communication

Users may send an inquiry or message to PEPEKS via the contact form. Sending a message does not constitute a contract, a transport booking, or a change or cancellation of an existing ticket, unless PEPEKS subsequently expressly confirms this.

Users are responsible for the accuracy of the information they enter into the form. The message should not include special categories of personal data, health information, identification document numbers, payment card details or other confidential data, unless providing such data is necessary and PEPEKS has expressly requested it via an appropriate communication channel.

Personal data submitted via the contact form is processed to respond to the inquiry, take action at the users request, perform a contract, fulfil legal obligations, or protect legitimate interests, depending on the content of the message and the purpose of the communication.

More detailed information on the processing of personal data is available in the PEPEKS Privacy Policy.

6. Permitted use of the Website

Users must use the Website lawfully, in good faith, and in a manner that does not endanger its security, availability or functionality, nor the rights of PEPEKS, other users or third parties.

It is not permitted to:

  • attempt unauthorized access to the Website, servers, databases or other related systems

  • impersonate another party or submit inaccurate information for the purpose of fraud or abuse
  • use the Website in a manner that infringes intellectual property rights, privacy or other rights of PEPEKS or third parties.

PEPEKS may restrict or disable access for a user who uses the Website contrary to these Terms or applicable regulations, to the extent technically possible and justified in order to protect the Website, other users or PEPEKS.

7. Intellectual property

Texts, photographs, graphic elements, logos, trademarks, timetables, databases and other content available on the Website may be protected by copyright, trademark rights, database rights and other intellectual property rights of PEPEKS or third parties.

Users may view, download or print the content for their own personal, non-commercial use, provided that the content is not altered and notices of authorship or rights ownership are not removed.

Reproduction, adaptation, distribution, public communication, sale or other commercial exploitation of the content is not permitted without the prior consent of the rights holder, except to the extent such use is permitted by law.

8. External links

The Website may contain links to websites, platforms or services of third parties.

By clicking on an external link, the user leaves www.pepeks.hr. PEPEKS generally does not manage external websites and does not determine their content, technical operation, availability, security measures, privacy rules or use of cookies.

Before using an external website, users should read its operators terms of use, privacy policy and cookie policy. Nothing in this article excludes any liability of PEPEKS arising from mandatory regulations, its contractual role, or its conduct in selecting and presenting the external service.

PEPEKS liability for damage related to the use or unavailability of the Website is determined according to applicable regulations. These Terms do not exclude or limit any liability that may not be excluded or limited by law.

10. Privacy and cookies

PEPEKS processes users personal data in accordance with applicable regulations and the Privacy Policy published on the Website.

Rules on the use of necessary, analytical, functional and other cookies, if such cookies are used, are governed by a separate Cookie Policy and the settings available through the cookie management tool.

The PEPEKS Privacy Policy and Cookie Policy relate to the processing of data and use of cookies on the www.pepeks.hr domain. After moving to Traveling.com or another external website, the privacy and cookie rules of its operator apply.

11. Amendments to the Terms

PEPEKS may amend these Terms due to changes in the content or functionality of the Website, the manner of providing services, its business model, or applicable regulations.

Amended Terms are published on the Website stating the date of the last update. Amendments apply from the date of their publication, unless a later effective date is specified.

Amendments to these Terms do not retroactively affect already concluded transport contracts, nor can they diminish rights already acquired by a user or passenger.

12. Governing law and final provisions

The use of the Website and these Terms are governed by the law of the Republic of Croatia.

The choice of Croatian law does not deprive a consumer of the protection afforded by mandatory provisions of the law that would apply in the absence of such a choice. These Terms do not limit the rights of consumers and passengers arising from mandatory regulations.

If any provision of these Terms is found to be void, invalid or unenforceable, this shall not affect the validity of the remaining provisions.

General Terms of Transport

Subject and scope of application

These General Terms of Passenger and Baggage Transport (hereinafter: the Terms) govern the rights and obligations between PEPEKS d.o.o. as carrier and passengers in public scheduled road transport performed by PEPEKS in international traffic.

The Terms apply to a transport contract concluded for a departure on which PEPEKS is listed as the carrier on the ticket. If several carriers take part in the journey, these Terms apply to the portion of transport performed by PEPEKS, unless otherwise expressly agreed for the entire journey.

Charter, occasional and contracted transport of closed groups of passengers is governed by an offer, order or special contract with the party ordering the transport. These Terms apply to such transport only if expressly agreed.

Basic terms

The carrier is PEPEKS drustvo s ogranicenom odgovornoscu za prijevoz, trgovinu i usluge, Trnjanski nasip IV. 20, 10000 Zagreb, OIB 09182507965 (hereinafter: PEPEKS). Contact for general information is info@pepeks.hr.

A passenger is a natural person who uses the transport service on the basis of a ticket or other valid right. A ticket is a document, in paper or electronic form, proving the right to transport on a specific route, day and departure. Baggage comprises hand baggage kept with the passenger and checked baggage handed over for storage in the luggage compartment.

Traveling.com is an external online platform operated by Get By ApS, Klamsagervej 32, 8230 Abyhoj, Denmark. The technical use of the platform, the user account, order processing, payment, technical delivery of the e-ticket and other platform services are governed by the platform's own terms.

Constituent parts of the contract

The transport contract consists of the ticket, these Terms, the timetable, the price list, and any notices given to the passenger before the contract was concluded. The information on the ticket and specifically agreed terms take precedence for a specific journey, unless less favourable than mandatory regulations.

If any provision of these Terms conflicts with a mandatory regulation, that regulation applies instead, while the remaining provisions remain in force. These Terms cannot exclude or limit passenger rights that cannot be reduced by contract under applicable law.

Conclusion and proof of the transport contract

The transport contract is concluded by purchasing and issuing a ticket for a specific departure, by accepting a transport offer at an authorized point of sale, or in another way expressly enabled by PEPEKS. PEPEKS undertakes to safely transport the passenger to the destination along the agreed route, and the passenger undertakes to pay the transport fare, except where entitled to free transport under a special regulation or offer.

The ticket is generally proof of the concluded contract. The absence or loss of a ticket does not affect rights that the passenger can prove by other appropriate evidence, where mandatory regulations so require.

Content, form and verification of the ticket

The ticket contains the data needed to identify the carrier and the journey, in particular the route, date and time of departure, and the ticket price. The ticket may be issued on paper or in electronic form.

The passenger must check the ticket details immediately upon receipt and promptly report any error to the sales channel through which the ticket was purchased. If the ticket is issued in a specific name, the ticket details must match the passenger's identity, and PEPEKS may request an appropriate identification document.

An electronic ticket must be presented on a device on which all data and the code required for verification are clearly visible. The ticket needs to be printed only if such a requirement is clearly stated in the purchase process or on the ticket itself.

Ticket validity, return tickets and seat reservation

The ticket is valid for the carrier, route, date and departure stated on it. It may not be used for a different departure nor transferred to another person if issued in a specific name, unless the sales channel's terms expressly allow a change.

A return ticket is valid for the outbound and return journey within 6 (six) months, on the route and under the conditions stated on the ticket or in the applicable tariff. If the return journey requires a prior reservation, the passenger must secure it in good time through an available sales channel.

If the passenger has been assigned a specific seat, PEPEKS may, for justified safety or operational reasons, replace it with another seat of an equivalent category. A reservation of a specific seat number alone does not entitle the holder to travel without a valid ticket.

Transport fare, discounts and additional charges

The transport fare is determined according to the price list in effect at the time of purchase. Before confirming the purchase, the passenger is shown the total price payable in that sales channel, including taxes and mandatory charges that can be calculated in advance.

A passenger using a discount or other preferential right must select the appropriate category when purchasing and present proof of eligibility when boarding. If the right to a discount is not proven, PEPEKS may require payment of the difference up to the full fare or purchase of a new ticket, in compliance with applicable regulations.

A charge for baggage, reservation, issuing a ticket on board, or another additional service may only be charged if published in the current price list or clearly shown to the passenger before purchase.

Purchase via Traveling.com

PEPEKS may provide a link on its website redirecting the user to Traveling.com to search for departures and purchase a ticket.

The technical purchase process, the user account, payment method, issuance or technical delivery of the e-ticket, and platform operating fees are governed by the terms of Traveling.com. For difficulties with that part of the service, the passenger should contact the support channel stated on the platform or the purchase confirmation.

If PEPEKS is listed as the carrier on the ticket, PEPEKS is liable for performing the transport, boarding, transport of baggage, the conduct of its staff, and passenger rights relating to delay, cancellation or other irregularities in transport, to the extent set out in these Terms and mandatory regulations.

Presentation and inspection of the ticket

The passenger must have a valid ticket before boarding the vehicle. The ticket must be kept until the end of the journey and presented to driving or inspection staff upon request.

Voluntary change or cancellation of travel

The possibility of changing the date, time, route or passenger name, and the possibility of a voluntary cancellation, depend on the type of ticket and the terms of the sales channel.

If the ticket was purchased via Traveling.com, a request for change or cancellation is submitted through the channel stated on the ticket, purchase confirmation or platform. If the ticket was purchased directly from PEPEKS, the request is submitted to PEPEKS or an authorized point of sale according to published instructions.

The general consumer right of unilateral withdrawal within 14 days does not apply to a passenger transport contract merely because the ticket was purchased online. This does not affect the right to a refund or rerouting arising from cancellation or delay of a departure.

Refund amount and method

A passenger may return a ticket no later than 24 (twenty-four) hours before the departure for which it was purchased.

A refund is generally made using the same payment method used to pay for the ticket, unless the passenger expressly accepts another method. For a ticket purchased through an external sales channel, the technical refund is processed by that channel, while PEPEKS resolves the merits of the request insofar as it relates to the performance of transport for which it is responsible.

The rules on voluntary refunds do not limit a passenger's right to a full refund, continuation or rerouting of the journey where the conditions under mandatory legal regulations are met.

Arrival at the departure point

The passenger must arrive in good time at the bus station or stop stated on the ticket and personally verify the carrier's name, destination and departure. Arrival at least 15 minutes before the scheduled departure is recommended, and earlier if baggage must be checked in, border formalities completed, or boarding assistance requested.

PEPEKS is not obliged to delay departure for a passenger who did not present themselves for boarding in good time.

Boarding, disembarkation and interruptions during the journey

The passenger boards and disembarks the vehicle at places designated by the timetable or by the instruction of authorized staff. The passenger must follow instructions on boarding, baggage placement, border control and safety.

During a scheduled rest stop, the passenger must return to the vehicle at the time set by the driving staff. If the passenger fails to return on time without justified reason, the vehicle may continue the journey. Where reasonably possible, PEPEKS will check whether the passenger is in the immediate vicinity, but is not obliged to wait if doing so would jeopardize the timetable, the rights of other passengers, or safety.

A passenger who voluntarily interrupts the journey has no right to use the same ticket for a later departure nor to claim a refund for the used ticket.

Conduct on board and safety

The passenger must behave in a way that does not endanger the safety, health, dignity or peace of other persons, does not disturb the driver, and does not damage the vehicle or others' property. The passenger must comply with reasonable instructions from the driving staff relating to safety and the orderly performance of transport.

Smoking, use of electronic cigarettes, consumption of intoxicating substances, unauthorized handling of vehicle equipment, blocking of aisles and exits, and any other conduct that may endanger the journey are not permitted on board. Consumption of food and drink is permitted only if it does not disturb other passengers or soil the vehicle, unless the driving staff determines otherwise for a justified reason.

Refusal of boarding and removal from transport

PEPEKS may refuse boarding to, or, at a safe and appropriate place, remove from transport, a passenger who does not have a valid ticket, does not possess the required travel document, seriously disturbs order, endangers safety, disrupts the work of driving staff, behaves violently or disruptively, or refuses to comply with a reasonable safety instruction.

The measure must be proportionate to the circumstances and may not be based on a discriminatory reason.

When removed from transport, the passenger's baggage is handed over where this is possible without endangering safety.

Damage and costs caused by the passenger

The passenger is liable for damage caused through their fault to PEPEKS, its staff, other passengers or third parties. If the passenger intentionally or through gross negligence soils the vehicle beyond ordinary use, PEPEKS may claim compensation for the actual and reasonable cost of cleaning or repair.

Any compensation must correspond to the cost actually incurred or to a pre-published, proportionate and legally permitted charge.

Passport, visa and other documents

The passenger is responsible for obtaining in good time and carrying during the journey a valid ID card or passport, visa, residence permit, consent for a minor's travel and other documents required by the countries of departure, transit or destination. The passenger must comply with customs, border, health and other mandatory regulations applicable to them and their baggage.

PEPEKS may, before boarding, check whether documents that are evidently required for the journey exist, and may refuse boarding if continuing the transport would breach a regulation or a decision of a competent authority. Such a check does not transfer to PEPEKS the responsibility for the completeness and validity of the passenger's documents.

PEPEKS is not liable for refusal of entry, detention, a fine, return, or other consequences arising because the passenger lacked the required or valid documents, except to the extent the damage was caused by PEPEKS's fault.

Children and minor passengers

A child must have their own ticket. Age and eligibility for a discount are proven by an appropriate document.

A parent, guardian or other person organizing a minor's journey is responsible for meeting the legal travel requirements and obtaining the necessary consents.

Independent travel by a minor is permitted only under conditions that PEPEKS publishes in advance or expressly confirms for a specific departure. PEPEKS may refuse independent transport of a minor if the age, documentation or safety requirements are not met, or if reasonably safe performance of the transport cannot be ensured.

Types of baggage and acceptance for transport

A passenger may carry hand baggage and check in baggage in the quantity, dimensions and weight set out in the price list, the ticket, or other rules published before purchase. Acceptance of additional or special baggage depends on available space, vehicle load capacity, safety requirements and prior confirmation by PEPEKS.

Baggage must belong to a passenger travelling on the same vehicle.

Hand baggage

The passenger brings hand baggage into the passenger compartment, places it where provided, and keeps it under their own supervision. Baggage must not block an aisle or exit, disturb other passengers, or endanger the safety and functioning of the vehicle.

Money, personal and travel documents, medicines, keys, jewellery, laptops, mobile phones, cameras, other electronic devices, fragile items and items of special value should be kept in hand baggage and given extra care.

Checked baggage

Suitcases, larger bags, backpacks and other accepted checked baggage are placed in the luggage compartment. The passenger must close the baggage properly and, where reasonably possible, mark it with their name and contact details.

If a baggage tag, receipt or slip is issued, the passenger must keep it until collection. On arrival at the destination, the passenger must collect the baggage without delay and check its condition.

Packaging and prohibited items

Baggage must be suitable for transport, sufficiently sturdy, closed and secured so that it cannot open, spill, scatter or become damaged, nor injure persons, soil the vehicle or damage others' baggage. PEPEKS may refuse baggage that is not properly packaged, exceeds published limits, or, due to its properties, cannot be safely transported.

It is not permitted to bring explosive, highly flammable, radioactive, toxic, infectious or corrosive substances, fuel, dangerous gases, weapons, ammunition, pyrotechnic devices, narcotic drugs, or other items whose transport is prohibited or specifically restricted, except where transport is expressly permitted by regulation and has been previously accepted by PEPEKS.

Items with an unpleasant odour, perishable or liquid items that are not securely sealed, and objects that may endanger or disturb passengers or damage the vehicle or others' property, are also not permitted. If there is reasonable suspicion regarding the safety of the contents, the driving staff may request information about the contents and refuse transport if the passenger declines to provide the necessary information or safety cannot be reliably established.

Special baggage, bicycles, prams and sports equipment

Bicycles, folding prams, musical instruments, skis, other sports equipment, and items of unusual dimensions are transported only if transport has been confirmed in advance and the vehicle has appropriate space available. PEPEKS may require a protective bag or other suitable packaging and may charge a fee that must be published in advance.

If special baggage has not been reported in advance, the driving staff may accept it only if available space and safety conditions allow.

Pets and other animals

A pet may be transported only if animal transport is permitted for the specific line and departure and PEPEKS has previously confirmed it. The passenger must comply with veterinary, border and safety regulations and use a carrier, leash, muzzle or other means required by PEPEKS or by regulation.

The animal must not endanger or seriously disturb passengers and must be under the constant supervision of the person handling it. PEPEKS may refuse to transport an animal if the prescribed or published conditions are not met.

Liability for baggage

PEPEKS must transport baggage it has accepted together with the passenger and hand it over after the transport is completed. PEPEKS is liable for the loss of or damage to checked baggage under the rules of the Civil Obligations Act and other applicable regulations.

For items the passenger keeps with them, PEPEKS is liable if the damage occurred through its fault or if liability arises from another mandatory regulation. In establishing liability, account is taken of the manner of handover and safekeeping, packaging, the natural properties of the baggage, the passenger's conduct, and the circumstances in which the damage occurred.

PEPEKS is not liable to the extent it proves that the damage resulted from inadequate packaging, the natural properties of the baggage, prohibited contents, the passenger's conduct, or another circumstance that releases it from liability under a mandatory regulation. No exemption or limitation applies if contrary to a mandatory regulation.

Reporting loss or damage and found items

The passenger should report visible damage or a shortage to the driving staff immediately upon collection, and hidden damage as soon as it can reasonably be established. The report may be supplemented by a written complaint together with the ticket number, a description of the baggage, photographs and other available evidence.

Items found in the vehicle are logged and kept in accordance with internal rules and regulations. A passenger seeking the return of an item must describe it and prove that it belongs to them. The cost of delivering a found item is borne by the passenger, unless the item was left in the vehicle through PEPEKS's fault.

Timetable and operational changes

PEPEKS endeavours to perform transport according to the published timetable. Arrival time may depend on traffic conditions, border controls, weather conditions, the operation of bus stations and other circumstances that cannot be fully foreseen during the journey.

For safety or to continue the journey, PEPEKS may replace the vehicle, change the seating arrangement, or organize transport with another appropriate vehicle or carrier, provided that passenger rights are not substantially reduced. Passengers will be informed of a significant change as soon as reasonably possible.

Information on travel disruption

In the event of cancellation or delay of a departure, PEPEKS provides passengers with available information on the status and expected departure time as soon as it is received.

Passenger safety and liability for the performance of transport

PEPEKS is liable for passenger safety from the start to the end of transport, including boarding and disembarking the vehicle, in accordance with the Civil Obligations Act and other applicable regulations.

PEPEKS is liable for its employees, driving staff, subcontractors and other persons it uses in performing transport, to the extent prescribed by law.

Relationship with sales platforms and other carriers

PEPEKS is not liable for the technical operation of an external platform, its user account, payment processing, or technical delivery of the ticket, unless liability arises from a mandatory regulation or from PEPEKS's actual contractual role.

Where part of the journey is performed by another carrier, that carrier's liability is determined according to its own terms and mandatory regulations, while preserving the rights the passenger can assert against PEPEKS under a single contract or mandatory regulation.

Information for passengers

Information on the timetable, stops, prices, baggage, passenger rights and contacts is available on the PEPEKS website, at authorized points of sale, and via info@pepeks.hr.

Passengers should check the information relevant to their specific departure shortly before travelling, in particular the boarding point and any operational notices.

Submitting a written complaint

A passenger or other person having consumer status may submit a written complaint to PEPEKS at the business premises where PEPEKS deals with consumers, by post to PEPEKS d.o.o., Trnjanski nasip IV. 20, 10000 Zagreb, or by email to info@pepeks.hr, marked "Written Complaint".

PEPEKS will confirm receipt of the complaint without delay. Where the Consumer Protection Act applies, PEPEKS will respond in writing no later than 15 days from receipt, clearly stating whether it accepts the complaint as justified. Records of written complaints are kept for at least one year from receipt.

For effective handling, it is recommended to state the complainant's name and contact details, the ticket or order number, the carrier, the date and route, a description of the event, the request, and to attach the ticket and available evidence. PEPEKS may not refuse to consider a complaint solely because the original ticket is not attached, if the contract and the event can reasonably be established by other evidence.

For difficulties with search, the user account, payment, the technical receipt of the e-ticket, or the functioning of the platform, the passenger should contact Traveling.com support.

Protection of personal data

PEPEKS processes personal data necessary for concluding and performing the transport contract, providing assistance, handling complaints, fulfilling legal obligations, and protecting its legitimate interests, in accordance with applicable regulations and the Privacy Policy published on the website.

Traveling.com, i.e. Get By ApS, processes data relating to the use of the platform under its own privacy policy.

For the operation and security of the Website, we may process the IP address, date and time of access, the requested URL, browser and device type, request status, and data on security events. PEPEKS does not collect or store full payment card details on its Website, as purchase and payment take place on Traveling.com.

5. Purposes and legal bases of processing

5.1. Operation, maintenance and security of the Website

We process technical data and logs to enable the operation of the Website, detect and prevent misuse, correct errors, and protect the system and users. The legal basis is PEPEKS's legitimate interest in the secure and reliable operation of the Website, within the meaning of Article 6(1)(f) of the GDPR. The Website does not use cookies or similar tracking technologies for this purpose.

5.2. Contact form and general inquiries

When you send us an inquiry via the contact form or email, we process the data to receive the message, check its content, respond, and conduct related communication. If the inquiry relates to concluding or performing a contract, the legal basis is Article 6(1)(b) of the GDPR. For other inquiries, the basis is PEPEKS's legitimate interest in communicating with users and responding to inquiries, within the meaning of Article 6(1)(f).

The mandatory fields of the contact form are name, email address and message, as without them we cannot identify the sender, the content of the inquiry, or how to respond. Please do not send payment card numbers, copies of identification documents, health data, or other documentation not needed for the specific inquiry through the form. Submitting an inquiry is not conditioned on marketing consent.

5.3. Scheduled and charter transport

We process data necessary for concluding and performing the transport contract, organizing the journey, boarding, safety, and providing the contracted service on the basis of Article 6(1)(b) of the GDPR. Where we must act in accordance with transport, consumer protection, accounting, tax, or passenger rights regulations, the basis is compliance with a legal obligation under Article 6(1)(c).

For charter transport inquiries and offers, we process contact details and data on the desired route, date, number of passengers, and other requirements needed to prepare the offer and, if accepted, perform the contract.

5.4. Complaints, passenger requests and legal claims

We process data from written complaints, refund requests, reports of lost or damaged baggage, and other requests in order to fulfil our obligations towards consumers and passengers, establish the facts, respond to the request, and establish, exercise or defend legal claims. The legal bases, depending on the case, are Article 6(1)(b), (c) and (f) of the GDPR.

5.5. Analytics and marketing

Under the Website's currently intended setup, PEPEKS does not use analytical or marketing cookies and does not profile Website users. If such processing is introduced, it will only be carried out after appropriate notice and, where required, prior consent under Article 6(1)(a) of the GDPR. Consent may be withdrawn at any time as easily as it was given.

6. Is providing data mandatory

Providing data is mandatory only where necessary to conclude or perform a contract, fulfil a legal obligation, or process a specific request. If you do not provide data marked as mandatory, we may not be able to respond to your message, prepare an offer, perform the transport, or resolve your request. Other data is voluntary and its absence does not affect the use of basic information on the Website.

7. Purchasing tickets via Traveling.com

By selecting the purchase button, the user leaves www.pepeks.hr and moves to Traveling.com, a platform operated by Get By ApS, Klamsagervej 32, 8230 Abyhoj, Denmark. Get By ApS independently determines the purposes and means of processing for operating the platform, search, the user account, payment, technical delivery of the e-ticket, support and its own cookies, and acts as a separate controller for that processing under its own privacy policy.

If PEPEKS is listed as the carrier on the ticket, PEPEKS receives and processes the data necessary to perform the transport, ensure safety, fulfil legal record-keeping obligations, and handle passenger requests. For these purposes, PEPEKS is a separate controller. For questions about the platform, account, payment and technical ticket delivery, please contact Traveling.com; for the performance of transport and processing carried out by PEPEKS, please contact PEPEKS.

8. Recipients of data

Personal data is accessed only by employees and other persons authorized for the tasks for which the data is needed, including drivers and operational staff where necessary for transport or passenger assistance. We may make data available to providers of hosting, Website maintenance, email and IT support who process it on our instructions, as well as accounting and legal advisors, insurers, other carriers involved in a specific service, and competent authorities where there is a legal basis for doing so.

We may exchange data with Get By ApS where necessary for a specific booking, performance of transport, or handling of a request. Where a supplier processes data on behalf of PEPEKS, we bind it by contract to confidentiality, security, and processing according to documented instructions.

9. Transfers of data outside the European Economic Area

PEPEKS endeavours to use providers that process data within the European Economic Area. If data is transferred to a third country or international organization, the transfer is carried out only under the conditions of Chapter V of the GDPR, for example on the basis of an adequacy decision of the European Commission, standard contractual clauses, and, where necessary, additional safeguards. Information on the applicable mechanism and how to obtain a copy of the safeguards can be requested via the contact in point 2.

10. Retention periods

We retain data only for as long as necessary for the purpose for which it was collected, taking into account statutory retention and limitation periods. Ordinary contact inquiries that do not lead to a contract or complaint are retained until the communication is concluded, and for a maximum of 12 months after the last relevant message, unless longer retention is required due to a specific dispute or other justified reason.

Data on transport, bookings, offers and contracts is retained for the duration of contract performance and thereafter for the periods prescribed by transport, accounting, tax and other applicable regulations, or until the expiry of the periods for exercising legal claims. Records of written complaints are retained for at least one year from receipt, and documentation on a specific case longer if required by regulation or an open dispute.

Technical Website logs are generally retained for a maximum of 90 days, unless set aside for investigating a security incident, preventing misuse, or exercising legal claims. Data on special assistance is deleted or anonymized after the journey is completed and any necessary follow-up has taken place, generally within 30 days at the latest, unless it has become part of a complaint, a legal record, or a legal claim. Once the relevant period has expired, the data is deleted or anonymized.

11. Data security

We apply appropriate technical and organizational measures having regard to the nature of the data, the scope and purposes of processing, and the risks to the rights and freedoms of individuals. Measures include restricting access according to business need, managing authorizations, protecting transmission and systems, backups, software maintenance, contractual confidentiality obligations, and procedures in the event of a personal data breach. No method of transmission or storage is completely free of risk, but we regularly review and adapt our measures to identified risks.

12. Your rights

Depending on the circumstances and the legal basis of processing, you have the right to request access to your data and a copy of it, rectification of inaccurate or completion of incomplete data, erasure, restriction of processing, and data portability. Where processing is based on legitimate interest, you have the right to object on grounds relating to your particular situation. Where processing is based on consent, you may withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

You can send your request via the contact in point 2. For data protection purposes, we may request additional information necessary for a reasonable verification of your identity. We respond to requests without undue delay, generally within one month. If the request is complex or a large number of requests have been received, the period may be extended by a further two months, of which we will inform you within the first month, stating the reasons for the extension.

13. Complaint to the supervisory authority

If you believe the processing of your data is contrary to regulations, you may contact PEPEKS at info@pepeks.hr. Regardless of this, you have the right to lodge a complaint with the Croatian Personal Data Protection Agency, Ulica Metela Ozegovica 16, 10000 Zagreb, email azop@azop.hr, www.azop.hr.

14. Automated decision-making

PEPEKS does not, through the Website, make decisions that produce legal effects or similarly significantly affect an individual based solely on automated processing, and does not profile Website users.

15. Amendments and effective date

We may amend this Policy when processing activities, Website functionalities, suppliers, or regulations change. The current version is always available on the Website, indicating the date of the last amendment. We will notify users of material changes in an appropriate manner.

3. What categories of cookies exist

3.1. Strictly necessary cookies

Strictly necessary cookies enable basic operation, security, network communication, or a function expressly requested by the user, for example ensuring network security or enabling a function expressly requested by the user. If tickets, videos, chat, social media, external fonts, or other third-party content that stores or accesses data on a device are subsequently embedded on pepeks.hr, such content will be assessed and, where not strictly necessary, blocked pending consent.

8. Amendments, contact and date

We update this Policy when cookies, technologies, suppliers or regulations change. For questions about cookies, you can contact info@pepeks.hr or write by post to PEPEKS d.o.o., IV. Trnjanski nasip 20, 10000 Zagreb, marked "Personal Data Protection".

Passenger Rights Information

1. General information

Passenger rights in bus transport are governed by Regulation (EU) No 181/2011 of the European Parliament and of the Council of 16 February 2011 concerning the rights of passengers in bus and coach transport and amending Regulation (EC) No 2006/2004 (hereinafter: the Regulation), the Croatian Act on the Implementation of Regulation (EU) No 181/2011, and other applicable regulations.

The Regulation applies to passengers in scheduled bus transport where the place of boarding or the place of disembarkation is situated in the territory of a European Union member state. The scope of individual rights depends on the type of transport, the scheduled distance of the line, the place of departure, and the circumstances of the specific event.

Certain rights apply to all scheduled bus services covered by the Regulation, while additional rights are prescribed for lines whose scheduled distance is at least 250 kilometres. For charter or occasional transport, the Regulation applies to a narrower extent, in particular with regard to the consequences of road accidents, if the initial place of boarding or the final place of disembarkation is in the European Union.

This information is a summary of passenger rights. It does not limit the rights a passenger has under the Regulation, national regulations, or other mandatory rules.

2. Rights applicable to scheduled transport

Transport terms and ticket prices must be applied without direct or indirect discrimination of passengers based on their nationality, the place of business of the carrier or ticket seller, or the place where the ticket was purchased.

A passenger has the right to receive appropriate information about the line, departure and other circumstances relevant to the journey before and during travel. Information on passenger rights must be understandable and available at the latest at departure, and for persons with disabilities and persons with reduced mobility, upon request, provided in an accessible format where feasible.

A passenger also has the right to submit a complaint to the carrier and to receive a response within the periods prescribed by applicable regulations.

3. Persons with disabilities and persons with reduced mobility

A person may not be refused a reservation, the issuance of a ticket, or boarding solely because of disability or reduced mobility, nor may additional costs be charged for this reason.

Exceptionally, transport may be refused where necessary to meet prescribed safety requirements, or where the construction of the bus, bus station or other infrastructure physically prevents safe boarding, disembarkation or transport. In such a situation, the passenger will, to the extent prescribed by the Regulation, be informed of the reason for refusal and of available alternatives.

On lines with a scheduled distance of at least 250 kilometres, persons with disabilities and persons with reduced mobility have, under the conditions of the Regulation, the right to free assistance at designated bus stations and on board the bus. The need for assistance must be notified at least 36 hours in advance, and the person must present themselves at the designated point at the agreed time or, if no time is set, at the latest 60 minutes before the published departure time. If prior notice was not given, PEPEKS will make reasonable efforts to provide the necessary assistance regardless.

If an accompanying person is necessary to remove an obstacle to transport related to safety requirements or the construction of the vehicle or infrastructure, the accompanying person is transported free of charge where the conditions of the Regulation are met.

Where PEPEKS or the bus station operator is liable for the loss of or damage to wheelchairs, other mobility equipment or aids, the passenger has the right to compensation corresponding to the cost of repair or replacement of the equipment. Where possible, reasonable measures will be taken to provide temporary replacement equipment.

4. Cancellation, delay and overbooking on lines of at least 250 kilometres

If the carrier reasonably expects that a departure from a bus station will be cancelled or delayed by more than 120 minutes, or if the transport is overbooked, the passenger must, where the conditions of the Regulation are met, be offered a choice between continuation of the journey or rerouting to the final destination at the earliest opportunity and at no additional cost, under comparable conditions, or reimbursement of the ticket price and, where necessary, a free return trip to the first point of departure stated in the transport contract.

If the carrier does not offer the passenger this choice, the passenger may, in addition to reimbursement of the ticket price, be entitled to compensation amounting to 50% of the ticket price, under the conditions prescribed by the Regulation.

If the bus breaks down during the journey, the carrier must ensure the continuation of the journey with another vehicle, or transport to a suitable waiting point or bus station from which the journey can be continued.

Passengers must be informed of the cancellation or delay of a departure as soon as possible, and no later than 30 minutes after the scheduled departure time, where the necessary information is available.

5. Assistance in the event of a longer delay or cancellation

Where the scheduled journey duration is more than three hours and a departure from a bus station is cancelled or delayed by more than 90 minutes, passengers are provided, to the extent reasonably possible, with appropriate meals or refreshments in relation to the waiting time.

If an overnight stay becomes necessary due to cancellation or delay, the carrier provides hotel or other suitable accommodation and assistance with transport between the bus station and the place of accommodation. The carrier may limit the cost of accommodation to EUR 80 per passenger per night, for a maximum of two nights.

The right to accommodation does not apply where the carrier proves that the cancellation or delay was caused by severe weather conditions or a major natural disaster jeopardizing the safe operation of transport.

6. Road accidents and baggage

In the event of death or personal injury to a passenger, or loss of or damage to baggage caused by a road accident related to the use of the bus, the passenger or another authorized person may be entitled to compensation in accordance with applicable national law and the limits prescribed by the Regulation.

Following a road accident, the carrier provides reasonable and proportionate assistance with the immediate practical needs of passengers, which, depending on the circumstances, may include accommodation, food, clothing, transport, and first aid. The provision of such assistance does not in itself constitute an admission of liability.

The Regulation does not prescribe automatic compensation for every loss of or damage to baggage that is not the result of a road accident. Other cases of loss, damage, or delayed delivery of baggage are governed by PEPEKS's General Terms of Transport and applicable mandatory regulations.

7. Ticket purchased via a platform or another point of sale

If PEPEKS is listed as the carrier on the ticket, PEPEKS is liable for performing the transport and for the exercise of passenger rights relating to transport, regardless of whether the ticket was purchased via the Traveling.com platform, at a bus station, via another sales platform, or from another authorized seller.

The seller or platform through which the purchase was made is responsible, under its own terms, for the technical purchase process, the operation of the user account, payment processing, and the technical delivery of the e-ticket. This does not limit the mandatory rights a passenger has against PEPEKS as carrier.

8. Submitting a complaint to PEPEKS

A complaint regarding a breach of rights under the Regulation should first be submitted by the passenger to PEPEKS as carrier. The complaint may be submitted to:

PEPEKS d.o.o.
IV. Trnjanski nasip 20
10000 Zagreb
Email: info@pepeks.hr

It is advisable to state in the complaint the complainant's name and contact details, the ticket or reservation number, the date and route of travel, a description of the event and the passenger's request, and to attach the ticket and other available evidence. It is not necessary to provide information or documents that are not relevant to resolving the specific complaint.

A complaint regarding a breach of the Regulation must be submitted within three months of the date on which the transport was performed or should have been performed. PEPEKS will inform the passenger within one month of receiving the complaint whether it is accepted, rejected, or still under consideration. A final response is provided no later than three months after receipt of the complaint.

Where the submission is also a written consumer complaint to which the Consumer Protection Act applies, PEPEKS will respond within 15 days. These time limits do not restrict PEPEKS's right to resolve the complaint and respond earlier.

9. Complaint to the competent authority

If PEPEKS does not resolve the complaint in the manner and within the time limits prescribed by the Regulation, or if the passenger is not satisfied with the response received, the passenger may contact the competent enforcement body in the Republic of Croatia:

Ministry of the Sea, Transport and Infrastructure
Directorate for Road Transport, Road Infrastructure and Inspection
Road Transport Sector
Prisavlje 14
10000 Zagreb
Email: PravaPutnika.cestovni@mppi.hr

Before contacting the Ministry, the passenger should first submit a complaint to PEPEKS.

Frequently Asked Questions

The answers below provide general information about buying tickets and the transport performed by PEPEKS. For a specific journey, the information stated on the ticket, the applicable timetable, the selected tariff, PEPEKS's General Terms of Transport, and mandatory regulations shall prevail.

PEPEKS does not process direct online ticket sales or payments on the pepeks.hr website. Selecting the "Buy Ticket" button redirects you to the Traveling.com platform, operated by Get By ApS.

No. Clicking the purchase button takes you away from pepeks.hr to Traveling.com. The purchase process, payment, user account and technical delivery of the e-ticket are governed by the terms and privacy policy of the Traveling.com platform.

Payment and the technical online purchase process are handled by Traveling.com. PEPEKS does not collect payment card data through its website.

The e-ticket should be delivered to the email address provided at purchase within 20 minutes. If it does not arrive, first check your spam folder and that the email address entered was correct. Then contact Traveling.com support using the contact details on the platform or in the purchase confirmation.

The ticket must be presented in the manner stated on the ticket itself or in the purchase confirmation. If showing the ticket on a mobile device is allowed, printing is not required. We recommend checking the instructions stated on the ticket before travelling.

The ticket must match the date, time, line and route for which it was issued. If the ticket is issued in a specific name, the ticket details must match the passenger using it. The passenger must keep the ticket until the end of the journey and present it to the driver or another authorized person upon request.

The possibility of transfer depends on the type of ticket, the selected tariff, and the rules of the sales channel. If the ticket is issued in a specific name, it may not be used by another person, unless a change is permitted and has been carried out in advance via the appropriate sales channel.

The possibility of a change depends on the terms of the selected tariff and the point of sale where the ticket was purchased. For a ticket purchased via Traveling.com, a change request must be initiated through the channel stated on the ticket, purchase confirmation or platform.

Voluntary cancellation of a trip and a refund of the ticket price depend on the tariff and the terms of the sales channel. For a ticket purchased via Traveling.com, the request is submitted through that platform or another channel stated on the ticket. This does not affect passenger rights in the event of cancellation or a longer delay in transport for which the carrier is responsible.

For difficulties related to the operation of the platform, the user account, payment, or the technical delivery of the e-ticket, please contact Traveling.com support.

If the problem relates to the performance of transport by a PEPEKS bus, for example boarding, baggage, staff conduct, delay, or cancellation of a departure, please contact PEPEKS.

We recommend arriving at the departure point at least 15 minutes before the scheduled departure time so that passenger boarding and baggage storage can be completed in good time and safely.

The passenger is responsible for arriving at the departure point in good time. The bus is generally not required to wait for a passenger who is late.

You need to have a valid ticket ready and, where necessary to verify the ticket details, an appropriate identification document. Passengers must follow the instructions of the driver and other authorized staff, particularly regarding safe boarding and baggage storage.

If the ticket is issued in a specific name, the details must match the passenger. In case of incorrectly entered details, you should contact the point of sale or platform through which the ticket was purchased before travelling to check whether a correction is possible.

It is not permitted to bring items whose transport is prohibited by law onto the bus, nor explosive, flammable, toxic, corrosive or other dangerous substances and items that could endanger passengers, staff, the vehicle, or other baggage.

Baggage must be properly closed and packaged so that it can be safely stored on the bus. PEPEKS may refuse to transport improperly packaged, oversized, or dangerous baggage.

The passenger must supervise the hand baggage they bring into the passenger compartment. We recommend keeping valuables, money, documents, medicines and electronic devices in hand baggage under personal supervision.

Loss or visible damage to baggage should be reported to the driver or another authorized person as soon as it is noticed. We recommend submitting a written complaint to PEPEKS as soon as possible, attaching the ticket, the baggage receipt if issued, photographs of the damage, and other available evidence.

Liability for baggage is determined according to the circumstances of the specific case, the General Terms of Transport, and mandatory regulations.

Rights depend on the scheduled distance of the line, the duration of the journey, the place of departure, and the circumstances of the delay or cancellation.

For lines with a scheduled distance of at least 250 kilometres, Regulation (EU) No 181/2011 provides, under certain conditions, the right to continue or reroute the journey or to a refund of the ticket price, as well as assistance in case of a longer wait. More detailed information is available on the "Passenger Rights" page.

No. The Regulation does not prescribe automatic financial compensation for every delay. Rights depend on the length of the line, the duration of the delay, the place of departure, and whether the carrier offered the passenger continuation of the journey, rerouting, or a refund of the ticket price.

If PEPEKS is listed as the carrier on the ticket, PEPEKS is responsible for performing the transport and handling requests relating to delay or cancellation of transport to the extent prescribed by the Regulation, other mandatory regulations, and the General Terms of Transport.

A person may not be refused transport solely because of disability or reduced mobility, nor may additional costs be charged for this reason.

An exception is possible where transport cannot be safely performed due to mandatory safety requirements or the construction of the bus, bus station, or other infrastructure.

For lines where the Regulation's provisions on assistance apply, it is recommended to notify PEPEKS at least 36 hours before travelling and to state what assistance is needed.

If prior notice was not given, PEPEKS will make reasonable efforts to still enable boarding, transport, and disembarkation for the passenger, in accordance with available options and safety requirements.

You can send a written complaint to:

PEPEKS d.o.o.
IV. Trnjanski nasip 20
10000 Zagreb
Email: info@pepeks.hr

The complaint should contain the information needed to identify the specific journey, a description of the event, and the passenger's request. We recommend attaching the ticket, booking confirmation, photographs, and other available evidence.

PEPEKS responds to a consumer's written complaint within 15 days where the Consumer Protection Act applies.

For a complaint regarding a breach of Regulation (EU) No 181/2011, the passenger will be informed within one month whether the complaint is accepted, rejected, or still under consideration, and a final response is provided no later than three months after receipt of the complaint.

A complaint regarding a breach of Regulation (EU) No 181/2011 must be submitted to the carrier within three months of the date on which the transport was performed or should have been performed.

If PEPEKS does not resolve the complaint in the manner and within the time limits prescribed by the Regulation, or if you are not satisfied with the response received, you may contact the Ministry of the Sea, Transport and Infrastructure as the competent enforcement body. Before contacting the Ministry, you must first submit a complaint to PEPEKS.

To send a message you need to provide your name, email address and the content of the message. Without this information PEPEKS cannot determine who sent the message, what it concerns, or how to deliver a response.

If the message relates to a specific journey, you may state the date of travel, the route, and the ticket or reservation number.

Please do not send payment card numbers, copies of identification documents, health data, or other documentation not needed to resolve the specific inquiry or complaint through the form.

If PEPEKS is the carrier listed on the ticket, it may obtain the data necessary to perform the transport and handle related requests from the Traveling.com platform, a bus station, another point of sale, another ticket sales platform, or a subcontractor involved in performing the transport.

Only the data necessary to organize and perform the transport, verify the ticket, communicate with the passenger, and resolve requests or complaints is processed.

Sending an inquiry or complaint is not conditioned on consent to receive marketing messages. Data from the form is used to receive, review, and respond to the message, unless a separate and voluntary consent exists for another purpose.

More information is available in the Privacy Policy.

No. The pepeks.hr website does not currently use cookies or similar tracking technologies.

If PEPEKS introduces cookies in the future, it will update the Cookie Policy in advance and, where required, request user consent.

No. After moving to Traveling.com, the data processing, cookies, and operation of that platform are governed by the rules of Get By ApS. PEPEKS's Privacy Policy applies to the data processing that PEPEKS carries out as carrier and operator of the pepeks.hr website.

Operational data, including timetables, stops, prices, and seat availability, may change. For a specific journey, the information stated on the issued ticket, the applicable timetable, the selected tariff, the General Terms of Transport, and mandatory regulations shall prevail.

If you notice a possible error on the website, please contact PEPEKS to have it checked.
